Unregistered trademark on the letter M and the word cap :lol:
pretty sure some if not most of those are BS ... just like this patent claim.. i can see now why simrell and dynavap get along so well for example.
trademarking common words and letters is something else. even words containing dyna are tied to preexisting items or businesses. plenty of examples if you google each word.
pathetic ... losing my respect for dynavap fast.

And as predicted, George is trying to work things out about the UFO. That is a good outcome for everyone if it works out.

how come serious business don't feel the need to plaster TM's and "Patent pending"'s over their promo materials?
taking a look a s&b's page i see no mention of anything like that.

do they think it somehow looks better to consumers? (it doesn't, it makes them look silly and insecure)
or do they think it's a deterrent for anyone interested in ripping them off? (i'm gonna assume they wouldn't care since it turns out none of it holds up)

I've been thinking about this and it's practically redundant, in the UK at least we have Passing Off Laws, which mean if you try and do anything that is clearly trying to cash in on someone else brand name, designs, look, feel, whatever... the original company is protected, because that's clearly not playing fair. Registering a Trade Mark on top of this is loading both barrels of the shotgun - it is worth doing for your main brand name / logo but probably little else, each situation is different of course. Registering Teatime as a trademark for your online chat time is fucking batshit crazy out there extreme!

If a competitor releases a similar product with the same name, they are not really very bright, the whole point of giving a product a name is to differentiate it from all the other products out there. As a competitor making a similar thing, but different - you REALLY WANT a different name! Choosing the same name is just going to cause confusion, make people dislike you, think you are foolish etc. it's a stunningly bad marketing decision, which is why NO ONE who is serious about building a name for themselves does this! and... why making all those names trademarks is absurd!

The ONLY time a third party would want to rip off a brand product name is if they are deliberately trying to produce clones of a product, which again is protected without going to the trouble of registering, Copyright Law and Passing Off Law apply by default, you don't need to do anything in the UK. I don't know what the situation is like in the US but I imagine it is similar.

Patents are specifically for functionality - so not relevant for names, logos, artistic works, one offs, they are specifically about protecting the *function* of a product typically intended for mass production. So we are a bit off topic here, but whatever, I don't care if no one else does.

I think you are correct, I think this is coming from a position of fear... although why I can't quite fathom, DV have a remarkable place in the community, they even have a whole bunch of third party companies producing accessories for their product - this is the holy grail of product development. They literally got it sorted... this trademark / patent registering frenzy is just weird, possibly greedy, possibly preparing for a war... who the fuck knows! It's bonkers whatever it is...

I am just laughing at them at this point. They are almost *asking* to be ripped off!

So the IG account got locked. Seems this has happened to other people who stood up to Vaping Fans. I can't prove it but I suspect foul play. I am working with IG to hopefully get it unlocked but if anyone can help there you would have my gratitude. This is about as big a mess as I have seen in all my years following and working in this industry.

I am very sorry to hear about this, and for what it's worth, more generally, my part in it by challenging the initial unfounded accusation of criminal activity.

In Europe we don't need to use the R or TM symbols, it's a US thing.
yeah but i mean, none of those sites have a link to patents and trademarks on the main page like dynavap has:
US s&b site, arizer, 7thfloor, boundless, davinci, pax, vivant, newvape, ditanium ... am i missing any US based companies?

only noticed taffe bowle has mention of patents but they are short and to the point not mostly pending like dynavaps ... what is the message they are trying to convey to the visitor?

most those other sites have the words like customer care on the front page, dynavap has frivolous pending patents, ridiculous trademarks and "send us your idea"...

i think George is just doing the smart thing, but having stuff like cap and tip, the core of the device, pending for so many years now looks weak and can send the wrong message. get the shit off the front page, at least put it under a menu like about us, what's the point of swinging empty guns around?

I seriously doubt he has anything that could stand a challenge assuming he actually get the patents. Perhaps some think claiming patent whatever makes their product more cutting edge 'cause it uses patent alien technology.

Personally and patent issues aside, I will pay zero dollars and zero cents for his stems. YMMV

Patent pending don't even really mean much other than to say a patent has been filed. Nothing that would indicate ownership.

I don't really know much about Simrell. But who the hell would patent some tube designs.

And making it super clear the design was patented seems like a way to bully people who might want to sell some tubes.

And WTF $150 for some simple ass tubes?

They just bully people cause they know these are $10 tubes and just want to push $150 tubes.
