Touble with the law today.......But they didn't get my vape!

HrWell, I fudged up. No need for French yet...

As I'm driving today, a small incident of an idiot driver( he was textng during a green light, stopped, so i went around him. He sped up and acted like he was going to side swipe me) leads to me being instigated into getting out of my car ready to box this individual, as coincidentally I was on the way to the gym for my lifting/boxing regimen anyways.
An officer approaches fast, just during yelling, and essentially just takes the older gentlemans side (40 maybe) although he alnost hit me and yelled at me to pull over, not the other way around.
As I get my license from the car, the officer complains of a weed smell.
I used to combust heavily and I think it permeates in there...i need detailing.
He insists I have weed, I insist I do not. I did.
The other gentleman thought he could go, so as the officer turned around to correct him I slid my mflb under the vehicle.
He searches. He gets angry. Searches more, and since he can't find weed he finds an empty alcohol bottle in a garbage bag, from a friends bday party, and charges me.

Granted, i dont drink often, this was a bag with food garbage, receipts, papers, tissue, etc from cleaning trunk a short while back. For some reason, probably finding more garbage, I must've brought it in the back and left it.

He says I have open alcohol and gives me the ticket, while its obvious I'm in gym clothes at 11am right by the gym I must enjoy lifting drunk he assumes....I guess.

Again, he insists I have weed. We do the usual back and forth, he looks again, finds nothing.....and figures that I need a charge for being the "agressor" and that my pulling over was negligent driving.
Pay 300 to the city in 7 days or it jumps to 1000.
Then, court for the obvious BS alcohol charge. Judge should be easy enough I hope.


Didn't lose my driving, just ID, but am kinda not good $ wise currently.

I don't know what open container laws are there, or even what they are today, but 'in the day' here in California it read "...from which the seal has been broken, and some of the contents removed..." in the definition. To have any 'meat' it had to be coupled to a "HBD" or "in and about". You had to either also be cited for "had been drinking" or drinking "in and about" a motor vehicle, otherwise you're hauling garbage. I know a workmate who 'beat the rap' that very way.

OTOH, I'm not so sure the cop was out of line. He comes up on a slugfest in the making by two guys who should have been in their cars doing other things. One sounds fairly benign, you OTOH sound aggressive, combative and (correctly deduced it seems) under the influence of drugs? In the other citizens place I'd hope for response along the those same lines from the man. Traffic altercations are one thing, sounds to me like either or both of you were also open for assault.

Glad nobody got hurt (except financially of course), you might want to see if you really don't fit the hauling garbage mold. Like I say, I know at one time and place the key was "...some of the contents...". That old 'scope and intent' thing? It fits the scope (it is an open bottle, maybe) but not the intent (to stop folks who are legally sober from sucking on cold ones as they curse down the highway of life).

I believe I may have worded it in a manner that makes you all (most) think i was the aggressor? No sir.
I did not start it, nor bring up the physical aspect. That was surprisingly enough the older gentlemans action.
I've never been the "turn the other cheek" type.
I simply got out of my car, not necessarily to inflict violence, but to at least get the point across. I woupd rather be out of my car than have someone come up denting the vehicle and breaking windows, and I was confident that if he attempted to strike the process to subdue him would be easy enough.

To all of you who say never to road rage, it is much easier said than done when the car next to you is giving obscene gestures, yelling, and threatening. That will trigger testosterone in most men.

And OF, I was not under any influence. It was with me in minuscule amounts but not being used omw to work out.
The whole instance was on my way to train.

I will try the garbage aspect, as I can't see any good charge sticking.
The officer clearly knew I wasn't drinking. I told him to breathalyze, field sobriety test, anything.
Would've passed with flying colors, I RARELY drink and never in a vehicle.

Edit: I should've pointed out that we were exiting vehicles simultaneously practically. It wasnt me, out of my car, egging him on as i think some assume..

Even if he was the aggressor, you were on a road, or near one and could have driven away. If he tried to follow you could slam on your breaks and end up with a lucrative lawsuit if you really wanted to ruin his day.

My point is that there is nothing to be gained by getting out of your car. There is no point to get across. There are two men, very angry,and with thousand dollar toys hanging in the balance. I am sure that officer ran over as fast as he could and deal with you that severely because he has seen this sort of situation turn into a slugfest, bloodbath or worse in the past.

As well, my original point was that because he was the one being aggressive, you have no idea what he has with him that is making him so cocky. Could be a tire iron, could be a gun, could be nothing. You have no clue till he pulls it on you.

Either way, live and learn. You may not be the type but turning the other cheek is something you have to learn to do to make it in this world. I sure am not the type either, and learned that the hard way myself.

Then he called units and they ticketed me which they weren't in the right because they didn't have proof or even witness the "crime". Not to mention its not illegal to pass on the road that I did. yea I would go and fight it then. Most likely they won't even show up and you'll get it dropped. Usually they just hope they you paid it and don't show up.
