The Herbalizer

For what it's worth, when I purchased mine in March Carrie had said that there would be a 420 sale and that I could wait until 420 to see what the deal would be, but still order the march madness deal later on provided they still had the shredders stocked.

All I wanted to know from Josh is if he thinks I would be risking any loss if I sent my machine to the company. I know he suggests to send it in, but if a company may possible "go away" as he states, I wanted to know if there was risk involved. I feel slightly attacked from these responses but nonetheless I am still keeping my calm lol never did I panic or express any panic simply asked a question.

Let us get back on topic yes?

Then I suggest you contact Engineer via private message as he is not a representative of the company and has already expressed his opinion on this once in this thread.

I believe the law states that if their intentions are to close and their advertising an expansion they would in fact face charges of being douchebags.

On top of the fact that's false advertising at its best and would be criminal if they did so. Or stupid, but let's be honest - we're talking about fucking NASA engineers. I doubt the term stupid has been something they were ever accused of.

If their criminals, we'll soon see.

EDIT:

Just went and checked Herbalizer's FB page and they have taken down my question and their answer. I wondered if they might do that so here's the screen shot I took yesterday. Doesn't increase my confidence in Herbalizer that they removed my post though. You can still see the one from Shiloh below my deleted post.

I wasn't going to say anything, but I saw your post on Facebook. When I went back later, it was gone. That was a little unnerving. I don't know what to believe, but I know I love my Herbie. It will make me very sad if this company does not continue.

Well, I know that I'd delete it if someone posted something like that on my business FB page.

Would you rather have an small number of one person's friends upset that you deleted the post or would you rather have all your FB page readers suddenly sketched out by your company?

No matter whether they are legit or not, they don't want that post on their wall and I can't really blame them for that.

Not good. I still have a sore spot from my dealings with the VXH fiasco. The Herbie was actually a big reason why I was able to get over that. I'm not brand loyal, and will always be happy with getting what I paid for. The Herbie is expensive but it has delivered on the hype and, most importantly, been reliable. Even if Herbalizer the company will soldier on, I'm very skeptical of corporate greed and shareholder/stock run companies. I've seen a lot of good products go down in quality or go up in price for nothing more than faster ROI. I didn't know Herbalizer was a public company nor do I know both sides of this story, so I won't pick sides here. But the Herbalizer was/is a great product and I hope it doesn't get lost in all this. My suggestion would be crowd sourced funding for the next @Engineer project. Many companies including VXH have been successful at raising capital this way. If people want it, they will come.

I would very likely support @Engineer in a crowd sourced project. We have his first project as proof that he does good work. I'd love to see his new vaporizer bury the corporate Herbalizer.

@Engineer: that is absolutely savage! It seems like this is becoming standard practice in the US and is a very telling sign of the times we live in.

I, for one, find it absolutely abhorrent and hope that the "investors" that kicked out the actual creator and driving force behind this innovative product get what's coming to them. Karma is a bitch!

@Engineer, I will support any product you choose to bring to the market and will back any crowd funded campaign you start! Really appreciate your transparency. You will persevere! Hope you return to the "brainstorming with engineer" thread should your time permit. All the best brother.

You guys shock me. It's scary how based on the word of someone who we don't know, stating allegations against a company that forced him out for reasons unknown but said company chooses to remain quiet at this point (most likely because their in a legal battle) and regardless of their side of the story your ready to crowd fund one side?

Wtf! He could have been banished from the company because he's fucking batshit crazy but hey, fuck it, please take my money. In a legal battle and probably received letters of cease and desist but he still seems to slam them. If he's so innocent where the fuck is Bob and Sheila? Don't you think they might defend him?

In stead of getting ourselves into a stupid decision just fucking wait. Since when are we the judge and jury? We don't know the fucking truth!

He's been a member for fucking years but without anyone knowing until he felt he had an agenda. Hello! Against the fucking rules. What else has he lied about?

Don't get me wrong, he could be in the clear but that's my point. I have no idea. And until then, I for one ain't throwing money at fucking anyone until I do know.

I have to agree with @mvapes we are only hearing one side, and everyone is believing it; Granted he seems to be a nice guy, when you have bad blood, you're going to be negative towards it.

as for Lazy's message being taken down, I agree with a comment about their business outlook. It doesn't look good that accusations are being posted, but at the same time, it looks sketchy from our side that it was removed, and people should see that everything is "okay," from the post.

As for warranties there is a few things. 1. If they try to void our warranty, but still try to sell products they would get bashed and lose their business. 2. I don't know how the law works, but I'm sure a nice lawsuit from every member of FC's herbie thread would be upsetting to them for voiding their warranty and promises towards their product.

Also, even IF they VOIDED THE WARRANTY I wonder if @Engineer could fix the units? I would pay to get my unit fixed if someone else could do it for sure.

Next I wanted to ask @Engineer about the screen sizes. It seems that the top screen slot is smaller than the bottom screen slot, so I'm curious if the screen size that Herbie uses(that no one can find) is inbetween what the bottom screen and top screen slots should be?

Basically this comes down to can we buy screens that are bigger for the bottom slot? I believe the Herbie screen size is 9/16ths, so I think I've seen 1/2" and 5/8th" screens. Would the 5/8" screen fit inside the bottom portion of the Herbie slot, or should we stick with the Herbie Screens? I am looking to buy a 24 pack on the website so I'm curious if you have any other screen recommendations since it's about 15$ for 24 screens....

I was also thinking of buying a second Herbie as a backup since there's a 150$ off sale, but I'm not sure if that's a good idea(just money wise), or if I should go for it? Thoughts peeps?

Overeall I love Herbie, but don't want to be without it/it breaking on me...

I rely heavily on my Herbalizer, and don't want to be without it either. If it were me, I'd wait a little while. In fact, that is what I am doing. Waiting, and hoping for the best at this point.

I'm not an attorney, but it seems to me that publicly stating your expansion plans when you've already started shutting down business would open a company to a heap of potential legal trouble.

I'm not an attorney either (my brother is), but I do have a grasp of basic legal concepts: like the corporation. The whole point of incorporating is so that the company becomes the legally responsible entity, and not the business owners. Companies are under no obligation to act "morally" either: they only care about maximizing profit however possible. The only reason that lawsuits have a deterrent effect is because they cost money (both in terms of cash and in terms of public image), and companies are in the business of reducing costs wherever possible. The idea a dying company would fear a "false advertising" lawsuit, and modify its behavior because of that threat of financial loss (when it already plans to close and liquidate its assets anyway) is pretty silly.

It is pretty common practice for companies to continue to project "business as normal" to both the consumer and low-level employees right up until the day the doors close.

At that price you could get a new or lightly used Volcano. It's just as high-quality and the manufacturer is healthy and stable.

Herbalizer may recover from this, but I think it would be prudent for everyone to take a "wait and see" approach before investing hundreds of dollars.

The emotion behind this discussion is impressive. First, crowd sourcing a new product is tempting and the encouragement is truly appreciated. I've still got a lingering bitter taste for it though, but that could change at any moment.. One thing is clear, the future is unknown.

I don't recall suggesting that I'm a saint, or asking anyone to pick sides. Time will tell and the truth will be, eventually, known. I mean come on, I designed satellite computers, guidance systems for nukes, and a vaporizer :brow: But I have not said anything untrue, at least not to my knowledge.

On a Tech note, the top and bottom screens are the same size but not a standard size or weave. The screens made for Herbie are optimized, but others will Work probably just fine. Add long as they are clean. And be careful not to always trust your eyes, the screens can get buildup that affects performance without being visually evident.

Acting like it's business as usual is a lot different then falsly advertising growth with intent on dissolving the company is not only immoral but illegal as well. I mean I would hardly say it's silly considering if what your saying is correct that would mean we should all incorporate. Protect ourselves from John public and we could do whatever we want.

Not quite, were not talking about a major fucking corporation with a board of fat cats on wall street. Were talking about self funded fucking vapor nerds. Have we not learned yet that in this community the developers and manufacturers image is ALL they have.

Do you think because they're protected by the "corporate veil" a bank is going to back them in what's still federally an illegal activity?

So, let's be honest here. Not only only are we AGAIN fucking assuming what kind of fucking corporation they are, a sole proprietary, s corp, llc, etc.. But were also saying that our country's legal system has the biggest loop hole in corporate history and it's been overlooked until now.

I could see lawyers everywhere congratulating their clients on they're new corps and while handing over a new seal and certicates they remind you, "hey, don't forget that if you get blamed for anything immoral you just say "it wasn't me, it was the company"!

Lol, silly.

@DarkEnigma I'm not talking about if they close business, but if they are trying to get out of warranty with changing companies/structure. They would be screwed and people would know who they are. I doubt that Herbalizer is going to just poof after they are making so much money off of the units and accessories.

@Hotz for that price I would spend the extra 200$ FOR A VALID WARRANTY and a NEW UNIT. IMO I wouldn't want a used unit for fear of issues, and if you have issues Waranties aren't transferred anyways...

@Engineer so the "slots" are the same? It seems like it's hard to jam a screen into there compared to the bottom screen which seems like it could fit a bigger one.

I guess I'll go by a 24 pack (was thinkiing 2 of them just incase things go sour), so I guess I will. DO people think I should get 24, or 48? Maybe I could send some to others if they need it tooo.

I guess because you had a bad experience with this company that you're scared to do it again, but it's just the beginning and if you can make something amazing, then people will buy it!

I have a lot of ideas for a vaporizer myself(I write software), but not really an engineer even though I nejoy building stuff :).

It sucks there is all this bad blood, I just hope it settles as I love the unit, but as i said befoire accessories and shit is EXPENSIVE. 70$ for a magnetic bowl?

Also I wonder if a new bowl can be built for this, as I really love my double screen method for the bottom, and I HATE getting the screen clogged.

Thanks all

I've been lurking here for months (since I got the Herbie) and now it sucks that my first post is on such a sour note.

Did anyone notice that all the accessories are going out of stock little by little and not being re-stocked? I was going to try and load up on accessories, just in case, but everything I want is gone.

I was hoping to get the accessory pack and a 24-pack of screens: both gone. Damn near every vendor that sells the Herbalizer I can find has stock issues as well. Not a good sign, IMO.

Please provide support for this statement. I think you will find there is none.

Do you think because they're protected by the "corporate veil" a bank is going to back them in what's still federally an illegal activity?

Again, please provide evidence that a company saying "the product is not going anywhere and the warranty isn't going anywhere. We're preparing to scale up. More products, more accessories, more everything!!!" and then closing soon after is "federally illegal".

@DarkEnigma I'm not talking about if they close business, but if they are trying to get out of warranty with changing companies/structure. They would be screwed and people would know who they are.

It has happened before. It will happen again.

There is a shocking lack of of basic knowledge of business law on this thread... I would advise anyone who is thinking of buying an Herbalizer to do their own basic research before taking any statement here (including mine) at face value.

The following is a copy and paste from Herbalizer's Facebook page. I did not include the name of the person that asked the question.

  • Will they be covered under warranty? Who will warranty them if you are not in business next week?

Hey Chris! The claims you may have heard are false. We are in business...and have no plans of going anywhere. As a matter a fact, we're preparing to scale this company to the masses! We want the herbalizer in the hands of casual users, medical patients, vets, ect... The Herbalizer is a one-of-a-kind product hasn't gotten the exposure it truly deserves!!! The company is in transition to a new owner, but there's no way we're letting Herbie go away!! All for the best...you'll be hearing much more from us in the near future

Thanks for addressing that @Engineer it clears up questions we've been asking for over a year.

I think we'd like to try a 9/16" screen size, but what density would you suggest if factory screens are unavailable?

@DarkEnigma - if you'd like to call me out let's do it privately. Your quoted comments are completely out of context in relation to your question. You ask me to support something in which my entire post was based on the fact that there was no fucking evidence to begin with.
As far as the law and business, again your comments were deliberate and you follow with the same exact fucking information I was saying in different text totally contridicting your comment.

I told everybody just as you did to do their fucking research and made a statement about an outlandish comment stating that part of being a corporation is being able to act in any fashion you'd like regardless of ethics as there would never be legal ramification cause it wasn't you that acted like a crook, it was your fucking company.

I know your new here but read back a few pages and see where this started. As for facts, see who's been part of this since day fucking one. Aside from the fact that my fucking name was on their original website endorsing the product.

I appreciate your post and btw, welcome to FC.
