Have you tried contacting Buy.com? Maybe a call in to them with the word 'fraud' sprinkled in the conversation might shake them up a bit.

The guy I bought my first house from had a fun expression for such occasions. He'd say "I don't know personally, but my Brother-in-Law, the crooked lawyer, says......". Not so much a joke, turns out his sister was married to a crooked lawyer, a Ambulance Chaser of the first stripe who was deep in a net of 'experts' milking insurance companies with fake accident claims. The guy fell into it by accident, his sister looked up a doctor in 'John's book' for a neck pain problem he'd had since his Navy days. Two days of bouncing from Doctor to Doctor ('referred by John') netted a little over $20,000 in bills he was told to ignore......

Anyway, "my Brother-in-Law, the crooked lawyer, says......" could well be magic words?

I think this isn't grey market. It is just bs to get off of warranty issues IMO as it is there distributor doing it or at least some of it. We already know that the ascent is being sent to ezvapes from the DV distributor at some point, so in your scenario OF it won't be warrantied which sucks as it is a legal buy.

No, I think it really is Gray Market (either spelling is common):
http://en.wikipedia.org/wiki/Grey_market

"A grey market (also spelled gray market), or parallel market,[1] is the trade of a commodity through distribution channels which, while legal, are unofficial, unauthorized, or unintended by the original manufacturer."

I think that fits here? Emphasis is theirs, note the 'original manufacturer' part.

Doesn't change the point it's BS of course. Or mean these guys aren't trying to slime out of it somehow.

And just because Ezvapes (or anyone else) gets it from GV or another 'authorized dealer' doesn't mean it's not covered, just that GV (or whoever) is responsible for the warranty, not DV. Assuming that was the deal.

If that's the case, GV would have agreed to cover it when they bought it from DV but not when they sold it to EV.....that's where the system broke down. That, I think is where you have to insist. DV had no say in that deal.

Looked at another way, contract law requires that 'due consideration' be given by both parties. I give you money, you give me a used car (or whatever). That defines our relationship. The guy that made or originally sold the car is not involved. In legal terms 'you have no standing' to insist DV service your gear, when did they ever agree to that and what did you give them for that? Normally it's part of the price....but you didn't buy from them. Complex for sure, but it's the way it works as I understand.

One more thing maybe. In the past DV did warranty them up until the ascent came out...coincident I think not. I bet at this point it is a money issue since so many ascents are being returned.

That's a spooky thought.......but entirely possible I think?

Hopefully that will all turn around and the 'all hands on deck to put out fires' drill can end?

Can't answer whether or not they had a policy change, but I do know that Rakuten and Amazon both use numerous sales affiliates. If I go to Rakuten web site I see 6 vendors that have the DV for sale, established places like Vaporganics, Wise Guy Vapes and the venerable Vaporizer King :o.

I've always gone under the premise if the vendor isn't authorized, then warranty claims will be a crap shoot at best.

Wow Dreamerr, good eye. I didn't catch that one. True, maybe you caught them at exactly the wrong time when they're swimming in refund requests and Chinese QC issues. Reminds me of that time I asked my wife for a back rub the day she got laid off. Almost lost a testicle that day....

Amazon and buy.com cause I don't care that they have a new name I can't spell or remember dumb move...have reputations they are not ebay even though they use other sellers. If they have crooks in there mix they have to dump them or they will eventually go out of business.

As to the warranty: My unit was brand new in the box when it arrived. It was advertised on Buy.com as a new vaporizer with a warranty. It has a valid serial number on it. Certainly, if my unit was missing a serial number and was stolen, I would never expect support, but that's just not the case here.

The worst part for me is I really loved this vape when it was working, but there's no way I'm going to do business with this company if this is how they treat their customers.

Marvel you may have much better luck with a replacement or repair by calling and speaking to DaVinci on the phone .

EDIT: before this I had bought two DVs that I gave as gifts , neither has ever had a problem and are no longer under warranty . But I bought them from an authorized dealer . Mine was a gift to me and was way under MSRP . [end edit]

I had the same problem with my DaVinci and the warranty . The seller only told me to lie to DaVinci and tell them I bought my unit at a local headshop as it was a gift that someone else Bought they the seller wouldn't even give me a receipt , nevermind a replacement (they were still selling them) . I sent emails to Dv and got the response you did .

When I took the time to really explain the situation on the phone DaVinci did take care of me . And that dealer who was on both amazon and ebay was soon gone .

Anyway, same bad luck with the charger plugged in? It charges normally?

Yep. It charges normally, but fails to operate in the same manner.

That's a great idea. I'll do that, thank you.

My Dv from pui still serve me well despites an initial fall of stock mouth piece. which forced to make tubing/screening mod from the very first pull. I prefer the beast i made. FV tube for mouthpiece with a iolite white mouthpiece at top. U-fine screens, 1 in pivotating part on chamber jonction, 1 at bottom of chamber.
heavy and even extracting and regular use, time will tell. to finish i improved the seal of chamber with a small portion of pv tube, it tended to loose to me. now the seal perfect but in other hand each pull drops temp... well.

Would love to see pics of your DV mods. The mouthpiece is a disaster, I'm trying tubing connected to a small bubbler, just working on getting the correct size ID on the tubing that fits both.

While I kinda like the MP I had good luck attaching the bubbler by using small (1/4 ID?) to mate with the stem then slipped an inch long piece of the next size up (3/8 ID?) to bring it up to fit the 14mm GonG. I can find the whip or DV (of course) so my guess about size will have to do, the technique worked at any rate.

Good luck.

Yeah I ended up getting some 3/8, and other sizes. I had a 1/2 ID I thought would fit on the bubbler GonG but it was way too huge ^_^

Cool. Another tip is if say the stem is a little loose in the fit (leaks or falls off), wrap a few turns of tape tightly around the outside of the tube an inch or so back to make a narrower part to grip the stem?

The Mouthpiece looks cool but a terrible design IMO . Only used around home , Not taking it off ,not using it for a handle , no abuse at all the unit only moves from an end table about 20 feet to the patio and back to charge . I'm on my third flexistraw . That's just poor quality and nothing but.

Yeah I've given up even trying to replace the snorkles. DefectiveByDesign and requires full DIY

My DV is starting to crap the bed. When I try to set the temp and hit the up or down buttons, it shows random lines and pieces of numbers, and even shuts off sometimes. The display will still read the temp that it's at, but I can't set it. So I decided to plug it in and see what temp it would stop at, guessing it would be the factory-set 405. Well it got to 440F when I decided to stop in fear of the thing melting. Inhaled....it was definitely 440. So I now have a DV with unlimited temperature maximum. I have to turn it off to stop it from climbing when I use it.

Well my recent replacement straw disassembled itself while in use last week, so i look forward to replacement/repair ideas for straw/snorkel. any tutorials or tips are appreciated.

On another note my DaVinci unit, I have found, will heat the chamber way above the temp I set it to if I am changing the temperature while it's already on. Like if i am at 340 and I want to ramp it up to 365 it will climb as high as 385 or so and then cool back to the 360 after ten to twenty seconds. I have noticed that the bigger the difference between the current temperature and the temperature I am setting it to, the higher over the set temperature it climbs. it has reached temperatures of 430 in this manner.

I found a work around that isn't really any effort at all, though. If I press the on/off button before I set the new temperature, it goes only as far as the new temperature when I push the on/off button again.

This might sound dumb but does anyone have a good technique for putting in the top brass filter? The one nearest the mouthpiece area? I keep bending them and pieces keep falling off when i try to poke it in using a small brush;

The max stetting is 405 on my particular unit. I've seen the temp go to 420+
DaVinci stopped replying to my customer service emails once the Ascent launch happened tho...

I asked them this very same question.

edit: I have the newer model with the magnet.

The mouthpiece is still a piece of Shiiiiiiiiiet

It varies. Mine goes to 430F (I just checked, it still does.....). The newer ones (mine's older, with a mechanical latch) are 405F I think, which is also 207C.

I hope it helps some?

I have a newer unit that reads 405F but it seems to run hotter , judging from the AVB 415-420F when compared to an Older DV .
