Hey Mollee!Hey everyone - got an obnoxious question to ask. I've seen several posts mentioning how a really clean Pax can usually be packed into luggage with no problem. But...is it even possible to hide some 'flower' either in luggage or on myself or is that just absolutely insane to think about in this day and age?
Edit: I'm referring to an airplane flight & getting thru security.
First off, I'm not a lawyer, I'm not your lawyer and this isn't legal advice
Unfortunately, there's no "honor" between the TSA and airports in MMJ or recreational states in that the TSA will overlook stuff because it happens to be legal in that state. That said, no matter what a TSA worker (they do not meet the technical criteria of "agent" or "officer") tells you, they cannot arrest you - in fact, their only recourse is civil with one exception...
So what gives them the power to stop you? Actually, really nothing. Kinda like the door checkers at Fry's - I've had them yell at me and follow out to the parking lot. (Petty thing, but this system is actually to prevent theft by their employees, not their customers and I take exception to it).
So.. wtf?
They can call in the local police who have plenty of officers available at each port (the second part of "air port"). They say "that guy shouldn't be in the terminal" and the police will remove you. They find you doing something illegal or what-no, they'll turn you over to the local police.
If they find an illegal substance (to their legal standard and if they care), but it's not considered illegal to the officers, the most they can do it not allow you entrance to the terminal. From what I've heard from just a few others' experience, the supervisors at a TSA checkpoint will try to detain you for a bit before calling the cops to make it seems like a much bigger thing (with scare tactics, etc.).
They cannot arrest you, they cannot detain you. They can tell the cops on you. They can file charges against you.
So.. if tattling can't get you in trouble, I wouldn't worry. If it can, (an "unfriendly" state), I would worry. The police in WA seems to know the difference between a patient's medicine and the really bad stuff and, if called in, will likely recommend you surrender your medicine to them so you can continue or take it back home. (Unlike other items, technically it's not legal to use the Federal Post to mail it to yourself)
Long-winded? Yeah... Bored? Yeah... but I take my rights seriously.
and of course... your mileage may vary
