Busted!

Damn! Good idea re: bus or train. Didn't think of it. I suppose the police will go after those routes next. Now it's starting to reach into beyond - belief ludicrous. Can you imagine dogs and cops running rampant everywhere in Nebraska, frisking every visitor? Doesn't that image and practice kind of put a damper on tourism in the state? I was actually enjoying sites and spending $$ there until this happened. Maybe people should boycott Nebraska.
Minnbobber, according to the lawyer they confiscated the 4:20 business cards, massroots stickers (marijuana leaf logo), and high times mag because if I should claim innocence in knowing nothing about mj, they could present it. I'm supposed to get everything back after court.

Good point, Grokit. But I bet they'd be chomping at the bit to do it, if that's how stuff started really getting funneled. I don't put anything past these people now. It's a righteous game for them. Like being trained in shooting up lowlifes in an arcade. That officer who interrogated me reeked of ambition. A real power trip. I could see the wheels in his head turning as he detained me for "for warning that I was driving too close". He was plotting strategy feverishly as he went along.

Thanks Poonman!
We're getting on the ground hopefully within the next few days. Our real estate agent sent us the paperwork. Everything is zoned fine and now it's a matter of credit checks, paperwork and negotiations. It's all my own investment at this point. We're starting small, but have big ideas. I'll message you with progress!
P.s. you can look up the facebook page with '4:20'. My Canadian partner just set it up a couple days ago.

You, @samantabha, have certainly encountered a 'disturbance in the field'. May only the good reign over you onward.

Now I'm even more worried about my travel east next week. I sort of figured I'd be OK if I avoided Colorado. I had planned to travel Interstate 80. Now I'm thinking I-70 and Kansas may be better.
Hell, from here head for Montana, the Dakotas and Minnesota.

Omaha! Seriously! We all need to learn and exercise our 'right to refuse'. Damn cops and robbers games. Damn small minds with power.

I'm simply trying to get to my hometown (50 years later), without suffering the disturbance of missing my medicine.
Do you look anything like a old man in Indian dhoti?

If you are traveling with your meds make sure you have a container that seals so no smell can be noticed. Maybe that wouldn't have made any difference? But 3 oz would be pretty smelly. What were you using to keep your herb contained in?

All of this freaks me out. I've had actual nightmares about this happening.

My lawyer told me (never in my life did I think I'd be using the words "my lawyer"!) that they're stopping EVERYONE on interstate 80 in Nebraska - principally the eastern and western sides. He says he even gets stopped with his Nebraska plates.
Wow. What does the Nebraska tourism board think of that?
As for Kansas, I've heard it's even worse if you're caught. What did you find, Carolking?
Oh one other thing: my boyfriend gets edibles shipped from a friend in California packed in plastic bags inside peanut butter jars (still holding most of the pb). Kind of messy, but it seems to work.

I think they actually go after rental cars but Amtrak is a good idea. Must try that.

I've heard it said they go after CO plates 'cause you're running dope, they go after out of state plates 'cause you came to CO for the goodies, they go after rentals 'cause you flew in and are driving home with the ganja-----so they're really targeting everyone, the b#stards.

It really sucks as they shouldn't be able to stop you unless you truly do something illegal, not just a BS reason like samantabha!!!
I wish someone big enough would legally go after them to stop this crap

It's funny because as I was leaving 3d cannabis in denver I noticed an elderly couple leaving the store and getting into a limo and for some reason it crossed my mind that maybe there were drones recording our plates while we were here. Hmmmmm

Sam,
if you get a chance, ask your lawyer the consequences of being stopped and asked to search your vehicle , and you say, "no thank you officer, I need to be on my way"?
Can they bring in the dogs etc when they have absolutely no probable cause other than they don't like the fact that someone refused their request?
Same thing if they ask are you transporting any xyz--can you say I don't care to answer that as that will also piss them off/ make them think you are hiding something.

What is the best legal strategy to not get busted from this nazi tactic if you are unlucky enough to get stopped??
Inquiring minds want to know :)

Minnbobber, I told them I would not allow a search but I made the mistake of saying "I guess so" for the dog (by this time I was developing a relationship with 'Zeke'). The lawyer told me it wouldn't have mattered anyway; they'd have found a pretext to search.
I guess there is no strategy apart from just not having anything visible in the car and not talking. They'll probably bust you anyway, but at least you're giving them less to hang yourself with later in court. This sounds grim.
But, well, it is.
I will bring it up to my lawyer again for your sake...

Probably. All an officer has to do is claim he/she smells Cannabis is your vehicle, and they can then use that as probable cause for a search on your vehicle. Most Judge's will most likely take the officer's word over yours, and that's really all it is since you cannot prove that an odor existed or did not.

This shit can't end soon enough.

The best part of the whole experience was chatting with all of the officers. Got to talk to the one guy about pros and cons of vaping/smoking vs edibles, about how marijuana should be legalized. He was the one who did accede to the benefits of Cbd oil for children, but insisted that smoking it was wrong, and who said his wife was pro-legalization. We went on talking for a while and though he kept his hard opinion, he made this curious comment "that's what's wonderful about America, isn't it? That we're all free to disagree".
Well, except, officer, I'm NOT free because you got to keep me in handcuffs and steal my personal property....

Often what they do is see if you've got some cash on you. They seize it and using laws fashioned to deal with organized crime they keep it, even if the case never comes to court. If you want to get the dough back you have to spend thousands and still may not get it back. Robbery.

In some ways this is the same issue as Ferguson. The police regard the population they are supposed to be protecting as prey.

They didn't take my cash which was a little surprising to me. I checked my purse carefully and all my cards (sans business cards and a Chase Bank receipt showing a $1000 debit - guess that was my big money laundering drug biz huh?) and my cash (about $250) were intact.
Speaking of cash, why don't we all start a campaign to boycott Nebraska? I just read the article (that Reflections graciously provided) about Nebraska clamping down on out of state drivers and their legislature talking about making the laws even stricter. Nebraska may not be the worst state to be caught in, but it does seem to be heavy on surveillance and with people interested in CO product it would seem natural that it would come to be avoided anyway. So why not just let the Nebraska tourism board know loud and clear that a big chunk of the traveling population will not be seeking it out? My boyfriend and I have spent big $$ there - with hotels, food, entertainment, and visits to historical and recreational sites. I happen to be passionate about the history of the Platte River and the Oregon Trail (I did my masters degree in history education), but if they threaten a felony and jail time, I'm NEVER going back there.
It's a real shame all around isn't it? Here we're buying legal pain relief in one state and paying taxes to support the school system there, and then we're being subject to unwarranted search and siezure, to personal embarrassment and curtailing of our rights, to THEFT of that same product that is hurting NO ONE in another state that is going to lose tourist dollars as a result. The only ones "winning" here are a few asshole (excuse me, I don't swear very often) lawmakers and police departments who have chosen to exercise a righteous attitude (and profit by it) and who get some glee out of stomping on tourists.
The system should rot in hell.

Found the article...http://www.tokeofthetown.com/2014/05/nebraska_cops_continue_to_complain_about_colorado.php from @Reflections

@Dafni ...so good to see you here! How are you doing? Did you receive my last email?

Yes, they were brutal to him. They didn't knock him down but they kicked at his legs and feet and they clasped the handcuffs on so hard that they cut off circulation in his hands. He was bent over very uncomfortably in the squad car.
They were nicer to me and even tried to advise me how to sit so I wouldn't hurt my hands. It's only because I'm so "feminine", slender and wearing a nice dress etc, that they did that. He has a big frame and has tattoes and earrings. As the first police officer was slight in build he may have felt intimidated by Kenn.
The more I think of the experience now, the more indignant I get. We are educated. We spend tourist dollars in their state. We intended no harm for anyone. In fact we've been kind and generous to everyone we've met. Yet we are treated like animals, made to believe that we have no rights and that we should consent to their interrogation into our personal lives, their searches of our bodies and our vehicle, their metal restraints.
Now I know a little bit of the horrible things that have been done to human beings throughout the ages, all on a pretext that someone is not deserving of dignity because they do a certain thing or fit a certain type. My mind is flipping into another realm, one of shock, of surprise. Even during that incident there were moments where we (the cops and me) related to each other as just real human beings. Why then the farce of making someone feel they are a criminal? It's like some strange disease comes over a person, a conditioning kicks in. We've got to wake up to the fact that every single person is deserving of love and respect. ALL the time. And that stupid laws are stupid laws. Get rid of them!

I know the answer to this, unfortunately. It goes like this, they ask if they can search, if you say no, that is the probable cause they need to search. It's unfuckingbelieveable. If you ever get into the situation where you are asked if they can search the vehicle, just say yes because at that point it's just a formality. Fucking fascist fucks.

We need to change these stupid laws at all costs.

While they might indeed say that a refusal is probable cause to search, that will not fly in anything but a kangaroo court.

Do not give permission for a search. You can't stop them if they proceed to search but loudly insist more than once that they do not have your permission. If asked if they can let a dog check your car same thing: not without a search warrant. The US constitution prohibits unreasonable search and seizure, ie police fishing expeditions. Ask if you are under arrest, and if not, leave. If arrested, tell them you are not saying anything until you see a lawyer and clam up.
