If suppliers continue to use suspect language in promoting such things, the FDA is going to step in. Just like they have against GNC. Claiming a widget can give you wings might garner (And, lose!) a lawsuit for misrepresentation, while saying it promotes alertness would probably be OK. Say it can correct some medical condition like depression, epilepsy, lupus?

FDA ban hammer. Even if it is, arguably, true.

I don't think this is as much something that chokes an industry, but something that keeps people in the industry from making claims they shouldn't.
