Would you fight this speeding ticket?

My girlfriend was clocked at 71mph in a 55mph zone while moving with the flow of traffic. Keep in mind that people rarely drive the speed limit on this particular highway (US 30), and that driving the speed limit would certainly disrupt the steady flow of traffic.

Long story short - the cop gave her a break by writing in 60mph instead of 71mph so that she wouldn't get any points on her license or an affected insurance policy. She does, however, need to pay $130.

Would you fight this ticket? Yes, she was driving above the speed limit. Yes, the officer gave her what I believe to be a rather substantial break. Yes, I smoke weed.

Her ticket states that she was going 60 in a 55, and with no prior traffic tickets I think a judge would consider reducing the penalty, especially considering the particular stretch of highway. Personally, I would argue that everyone else was going 70+ (I know, that's pretty dirty argument) and that people were still passing me (which is also true). Does that make me dirty? If it was a 30-50 dollar ticket, I would just pay it. But not $130.

Doesn't matter if she was keeping pace with everyone else. She was just the unlucky person that the cop decided to pull over. If you try to fight this, you won't win. Trust me, I know.

Also, don't be surprised if your insurance company finds out about this ticket.

Be careful with this! I have much experience in this arena!

The officer has the option of writing notes on the reverse side of his copy of the ticket. Many times they write actual speed clocked there. This copy goes to the judge and he will "throw the book at you" if you try to play the "but I was only going 5 mph over" card.

On the other hand, 60 in a 55 is a small infraction, so if you were to reschedule once or twice, the court case for this issue, the office probably wouldn't show up and the case gets dismissed.

Now, were it me and knowing I wouldn't receive a point..... I'd request reschedule of the hearing date at least twice, then hope the officer doesn't show.

Maybe try having one of those traffic ticket lawyers take a stab at it? I don't think it is worth fighting in court.

Examine the ticket closely. More than likely somewhere on it there is written "71/60" or something like that. This is how they notate that they used their discretion in citing the offense, and what it was taken down from. If you try to fight the ticket the officer and crown will prosecute you for the speed she was clocked at, not the speed on the ticket.

My advice? Pay the ticket. Yes it costs as much as a new Solo, but I don't think your going to win this unless this was her first offense and even then its a stretch.

Speeding tickets are a money making opportunity for the city. They could give darn about the reality of the situation, like how fast other cars are going. I tried to fight one of those camera tickets, and I learned a lot. They've got the whole scam streamlined. No way out

Literally the EXACT same thing happened to my girlfriend as we were entering the hell that is Iowa and their strict traffic laws, the funny thing is she was only speeding to maintain visibility with the car in front her (her brothers) that way going at least 80 the way he was creating distance. But I can't imagine an officer wasting time to pull someone going exactly 5 over if I were a judge.

But I'd just pay. Why fight when you were pulled over initially.

I'd look at the laws, why would you fight this ticket, you said she was going over the speed limit, that's what she was fined for. I'm not sure how that last bit is relevant.

I say fight it, if you pay the ticket you're admitting guilt. But in order to fight it you have to pay admin fees up to 50 bucks per hearing. I paid a parking ticket that was issued wrongfully because it would have cost me more to fight it.

Any other way you look at it no matter what you do it will wind up costing you more then you predict unless you just pay the initial amount. Show up with a lawyer and not only are you then looking at paying the maximum penalty, but then you have to pay the lawyer too. So whether it costs you 150 or 500 it's really all up to you. If you want to speed, and you don't want to pay, you gotta keep your eyes wide open, the five oh are sneaky sons of guns . Just my thoughts take care and good luck.
