My girlfriend was clocked at 71mph in a 55mph zone while moving with the flow of traffic. Keep in mind that people rarely drive the speed limit on this particular highway (US 30), and that driving the speed limit would certainly disrupt the steady flow of traffic.
Long story short - the cop gave her a break by writing in 60mph instead of 71mph so that she wouldn't get any points on her license or an affected insurance policy. She does, however, need to pay $130.
Would you fight this ticket? Yes, she was driving above the speed limit. Yes, the officer gave her what I believe to be a rather substantial break. Yes, I smoke weed.
Her ticket states that she was going 60 in a 55, and with no prior traffic tickets I think a judge would consider reducing the penalty, especially considering the particular stretch of highway. Personally, I would argue that everyone else was going 70+ (I know, that's pretty dirty argument) and that people were still passing me (which is also true). Does that make me dirty? If it was a 30-50 dollar ticket, I would just pay it. But not $130.
