Is ABV Legal?

Hi,

I was wondering, that if I was to get caught with my vape, but I had already had a session off it.

Has most of the THC gone, so the main ingredients is now CBD?

As CBD is legal, does that now make ABV legal and can be used as a defense for possession?

Does CPS have to test the ABV and prove it has an illegal THC content before they can prosecute?

Does this make policing dope laws even more impossible?

Or is there still too much THC in ABV to make it still illegal to posses?

Funny... I was just thinking about this. As legal patients here, we are limited to possession of 2.5 ounces of cannabis. Well, I've been saving my abv up for years not even thinking about being over limit.. and then realized that there is probably enough THC left in that abv to qualify it as cannabis.

And let's face it; most cops seeing abv would think it was just more weed. At the very least, they would arrest you. So I've decided I'd better process all of that abv into something or another and get it out of the house. Time to make some CBD oil and edibles!

ABV can definitely put you over, or even way over, possession limits. Also in some jurisdictions cannabis processed into food can be counted as the weight of the food rather than the weight of the cannabis that went into the food. A guy I knew in Oregon got into a mess of trouble for that once. So depending on the laws where you are and the interpretation of them processing the ABV could make it worse. I know where I live the possession limit for concentrates is significantly lower than the possession limit for the plant, but afaik they don't count against each other so having nearly the max amount of each is safest here.

According to the police in my area of NY ABV is indeed considered to be illegal. A recent bust netted a user that extra tier of charges because according to him all the ABV was included as evidence. Of course we live in the nation "no clear policy" so who knows how it works in other locations.

My friend got pulled over with a half ounce and lots of ABV. Up to an oz of bud is decriminalized, but the ABV put him a bit over an ounce. The cops didn't do anything when they pulled him over, but later that day he got a call from them where they asked what the brown weed stuff was. Since he told them it was basically trash they didn't count it.

So are we saying the THC content in ABV is high enough to still be counted as MJ?

I thought all the THC went at the lower temps along with the terpenes / flavs etc... or is it not that simple?

I remember seeing this come up in California at least a couple of times in the past, though the legal possession limit throughout the state is generally 8 ounces, so it's not quite as big of a deal for many people in my area.

Generally, ABV does contain much lower levels of the psychoactive cannabinoids that are controlled or illegal in most areas around the globe. However, even at their lower levels, the percentage left is almost always well above what is considered legal or not controlled. Additionally, both ABV and it's uses have become generally known among many law enforcement agencies. As such, should it test positive (which, generally speaking, it will), it's going to be treated exactly as Cannabis. Yes, in most modern areas of the world, it will be tested prior to being used as evidence in prosecution! I can't speak for places like China, Iran, North Korea, Eastern Europe, the Middle East, etc,.. as I've read that many of those places will imprison and execute on hearsay and rumors.

In areas where it's illegal to possess, or where you don't have legal permission (i.e. - caught with some in California, but you don't have the required Medical Marijuana Recommendation)... If you are caught with a vape thats filled with ABV, and if the officials are trained and experienced, you could easily be treated as if they had found a bag of buds in your possession. If you were caught, instead, by an inexperienced official, and assuming your ABV was pretty much tapped out of all cannabis related smells, you might get away with it, depending on what you say.

Regarding only those who are legally permitted to consume Cannabis, yet have a possession limit... The basic answer was that yes, it will almost always be counted against your totals! Unfortunately, should you be in a situation where this actually matters, you will very likely be dealing with one of the enforcement agencies (the world over) who choose too ignore both existing laws and policies making Cannabis use legal. Additionally, they also tend to ignore guidance from their senior leadership (President, for example), so they aren't going to care much that it's only ABV!

Furthermore, overwhelming public opinion leaning towards legalization/decriminalization doesn't matter to these agencies. Their overall goal is to target law abiding individuals in an attempt to imprison them, force them to quit, and intimidate others into following their "morally superior" beliefs and political views. Additionally, should they stop these practices they stand to loose a substantial portion of their budget and many will do anything they can to prevent that from happening. As such they are going to seize every opportunity to use each and every bit of evidence they can against you. They also have plenty of other tricks to further increase your charges and potential jail time, but I'm starting to get off topic.

I hope I was able to answer at least some of your questions with sufficient information!

It will still test positive for THC so you are in a bad situation if you get caught with it.

How much THC does it have prior to vaping?

I know it's dependent on plant, so am wondering about averages?

I was thinking of testing some to find out, but have you seen the price of test kits?

Cannabis is legal in North Korea believe or not. ABV is cannabis as longs as there is the least bit of active canabinoids.

Crazy enough, I've also heard that before! When I lived in Seoul, there were rumors of people in NK who used it to much (i.e. daily) and were labeled as addicts and sent to working camps. We were told this tended to discourage use except among teens who had secret places to smoke while they were listening to their smuggled k-pop. I'm not sure what to actually believe. Rumors, even official ones carried in by spies, are often wrong. Additionally, the few defectors I met either didn't want to talk about it or didn't know.

I don't remember the exact number, but from the documentary I watched and the few articles that talked about this a year or two ago, it was well above 0.2%! It was even highlighted that it would be considered illegal in the USA and EU.

I can only speak for myself, but when I lived in Paris for a few months after I retired, I was confident enough in my knowledge to treat ABV as Cannabis and wouldn't have spent the money to get it tested.

Also, keep in mind that both your style of vaping and your vaporizer model, could make the leftover controlled cannabinoids even higher! One of my friends uses the MFLB, his ABV is never completely used, I can often even find several small still green shreds. Another couple of my friends hate vaping all the way until their shreds are brown and toasty, they love the fresher taste for whatever reason. Their ABV is much higher in THC, for example, than mine (I vape until dark brown, almost black) and even mine has more than enough left over to get me in trouble if it wasn't legal.

I had never even considered the fact that ABV is still the same legally as weed! Not sure I really need to keep it anymore as knowing me I'll never get round to doing anything with it anyway.

I think its at least worth explaining to the officer that its used and (most of) the THC has been extracted, so in my eyes its pretty comparable to hemp, which is legal in most places.

At the end of the day you don't know how well educated in the subject the person on the other side of the conversation is. So if you could get in trouble, its worth arguing your side and if you get trumped, then plead ignorance.

Just my opinion mind :)

I have to disagree. I would advise no explanations what so ever. The least you say, the better off it will end. IMHO.

If your worried or even not, there lots of videos detailing how to handle a Leo confrontation. It's also prudent to take steps to defuse the canna ordor.

@1DMF In the UK where we live you need to have a licence to grow Hemp. From my understanding products made from Hemp Bud/flowers are illegal to sell. Seeds and stem only. So even hemp is a controlled substance in a way.

As such, CBD products made from hemp seeds and stalks are legal in the UK.

As you obviously know Cannabis is illegal in the UK. I believe that even if you had cannabis with 0%THC it would still be against the law as cannabis is a controlled substance. Cannabis is still cannabis whether or not it has THC in it. This is why you can not order USA legal state CBD products to your house in the UK and also why they cannot mail it internally within all 50 states. Maybe it's arguable in court that it is not phychoactive and is legal, but this would be a landmark case.

Anyway back to ABV. Your ABV is physical evidence that you consumed THC from the cannabis plant, a controlled substance. It is not hemp seed, stalk, or even flower. It is cannabis. Anything made from cannabis is illegal in the UK. That includes ABV. You might get the odd cop who would just take it from your possession and send you on your way. But to be honest they do that anyway here with personal amounts in all of my experiences. Thier face always lights up when they see my sticky hash. They don't even give me a ticket.

In the uk I feel that vaping is still unknown to the police, they are just catching on that people may be using these ecigs to get high...
But this whole vaping thing is beggining to blur the lines for them...
Our uk plods have never been up to scratch with the current situation at the time...now is no exception...

I doubt any of the police near me have ever seen bho or any sort of high quality concentrate...

I'm sure they will get a briefing soon about the changing mj culture...

Turn all your avb into oil...then you have fuck all anyway, and they may even just overlook it..

Well from everyone's replies and my internet searches, it seems this once again simply highlights how the law is a total and utter ass.

Non-psychoactive hemp is illegal to grow? On what grounds? You can't get high on illegal THC it doesn't contain any, so WTF.

Oh well, I had hoped to be able to argue the toss if I ever got nicked, guess I'll just carry on regardless!

Very interesting re-USA where it is legal, yet too much ABV takes you over some limit, even where it's been legalised the law is still an ass.

Where are all the intelligent, decent, normal people in charge of our countries and making laws?

ABV is absolutely not gonna be legal. In the eyes of the law, it is still cannabis. You have degraded it, but the law does not stipulate that cannabis must be pristine to be legal.

There is still going to be detectable THC (or an analogue or degradation byproduct - the law considers these the same for the purposes of enforcement in the US, UK and many other nations) left in your flowers in most cases.

If there is CBDA or CBD in the material, it will vape off at a rate not dissimilar from THC. Most of both major cannabinoids just can't stand the heat, and so get out of the kitchen, or oven as it were ;)

As far as ABV being legal, I can tell you this. A friend came by after I started vaping. She asked if she could try twisting up some ABV. I gave a her fatty's worth and a few days later she told me about it. She said she got a buzz. Since most people do something useful with their ABV (brownies, etc.) it definitely has THC in it.

PS my state is very repressed, the anti-seizure oil (made from seeds?) is THE only thing legal in our state.
Best to be subtle.
Being subtle has gotten me through 46 years of enjoyment with out one run-in with 5-0.

Are you looking for a loophole? is hemp legal there? charlotte's web might be a considered a hemp strain. Whats stated as illegal there ? do they mention both indica and sativa? if so does it mention
Cannabis ruderalis?
