(Meaningless?) Federal Vote on Marijuana Legalization is on the Horizon

I’ve been practicing corporate, transactional, and regulatory law in the marijuana industry for going on 10 years now. I’ve never understood exactly why folks get excited about, or even remotely interested, when various lifetime politicians in Congress push bills on the federal legalization/rescheduling of marijuana. Why? Because these bills notoriously go nowhere (for a number of what seem to be purely political reasons) and will continue to go nowhere, in my opinion, where marijuana (while extremely popular with most Americans and obviously with certain entire states) is still too politically hot to trust out-of-touch members of Congress to do anything meaningful about it, and especially now given that the nation’s priorities seem to revolve around dealing with COVID-19 (and rightly so).


The House’s planned floor vote in early September around the most recent federal marijuana legalization measure (the Marijuana Opportunity Reinvestment and Expungement Act (“MORE Act” (see the House version here, which was introduced last year)) is no different. While I’m glad to see members of Congress continue to try to chip away at the continued (failed) War on Drugs regarding cannabis, I’m honestly tired of seeing the fanfare attendant with these legalization bills. At the same time, my interest in these things is usually peaked when looking at what members of Congress are willing to push when it comes to nationwide legalization.


Yes, this upcoming vote is still significant and historic because neither chamber of Congress has ever voted on completely removing marijuana from the federal Controlled Substances Act (and the MORE Act is a bipartisan bill, too), but we all know where this is going–the Democratic-controlled House will likely pass the bill and the GOP-controlled Senate will very likely ignore it or shut it down. I also can’t ignore the fact that the bill’s Senate sponsor is Senator (and democratic vice president nominee) Kamala Harris who admittedly has a terrible record on prosecuting marijuana crimes from when she was the Attorney General of the State of California and is now in the past two and a half years miraculously behind supporting marijuana legalization culminating in a presidential election year. Pretty convenient
....

Marijuana use is on the rise among older Americans, with one in 20 saying they had used within the previous month, according to a new study.

About 5% of men and women aged 55 and older said they'd used marijuana or hashish in the previous month between 2016 and 2018, according to an annual federal government survey on potentially risky behaviors.

McConnell (Gobbles) is a dick, but remember that Biden still considers cannabis a gateway drug and Harris laughed about all the people she prosecuted and jailed for cannabis while admitting she used.

They passed COVID and Police bills months ago. The Senate refused to hold a vote on either. If the House is unserious, what's the Senate? They're all chucklefucks. In any case, it seems that Congress as a whole is just a make-work government program for ex-lawyers. They don't actually govern. So I guess one way to justify their six figure salaries could be passing a pretty reasonable Cannabis Legalization bill, even if it's sure to die in the Senate.

Also... if this bill did pass, our country would be a better place. Most of the people who live in the US would like it better than our current Cannabis situation. This is exactly the sort of thing Congress should be passing. It's not the bill that's "meaningless". It's our dumb political system, if they can't pass laws most people want passed.

Kamala Harris who admittedly has a terrible record on prosecuting marijuana crimes from when she was the Attorney General of the State of California and is now in the past two and a half years miraculously behind supporting marijuana legalization culminating in a presidential election year. Yeah, that's pretty fucking gross. But at this point, I don't care if William Randolph Hearst's ghost is the one who reforms America's insane Federal cannabis laws. Just get it done.

it is quite alerting too that for some reason we have this two party molecule system as well... notice how in mainstream there is a war on CBD over THC and for all purposes of the drug war THC is the bad guy and CBD only ETC..... all while there are 148 more phytocannabinoid compounds in the pl;ant that are similar to CBD and THC as phytocannabinoids

A new analysis of cannabis research funding in the United States, Canada, and the United Kingdom has found that $1.56 billion was directed to the topic between 2000 and 2018—with about half of the money spent on understanding the potential harms of the recreational drug. Just over $1 billion came from the biggest funder, the U.S. National Institute on Drug Abuse (NIDA), which doled out far more money to research cannabis misuse and its negative effects than on using cannabis and cannabis-derived chemicals as a therapeutic drug.
“The government’s budget is a political statement about what we value as a society,” says Daniel Mallinson, a cannabis policy researcher at Pennsylvania State University, Harrisburg, who reviewed the funding analysis provided to Science by the consultant who conducted it. “The fact that most of the cannabis money is going to drug abuse and probably to cannabis use disorder versus medical purposes—that says something.” The data confirm “word on the street” that government grants go to research that focuses on harms, says Daniela Vergara, who researches cannabis genomics at the University of Colorado, Boulder.
However, overall cannabis research funding in the United States is rising steadily, from less than $30.2 million in 2000 to more than $143 million in 2018, and money to explore cannabis medical treatments is growing—although not as fast as funding for research on harms....

I really think it’s a bad idea for “the cannabis community” to get lost in the weeds of individual phytocannabinoids: it plays right into the hands of BigPharma/“more research”/no meaningful action FOR US.

THE PLANT needs to be legal. Its USE needs to be legal. EVERYTHING ELSE is us scoring points for the other team.

here is NIDA = 95% of all research is to study harmful effects of the plants smoke in relation to man ingesting it ... ( monkeys in the gas masks)

about 3% then goes toward " cannabis use disorder" ... the last 2% is for actual cannabinoid medicines that is 100% outsourced to toher countries @ that point ... which is not really even NIDA field of research anymore
somewhere in the backoffice things are occurring however ... for example... Epidiolex is FDA approved , and DEA took it completley off of scheduling . it is a cannabis plant tincture . so as we still claim no medical value at al from the plant pharma has medical rights to make drugs directly from growing cannabis plant ( not synthetic lab made ) @ a cost of 32 thousand dollars a year for kids and dying people who seize == the world and its greed and man

Even in a state's rights federalism government theory, the feds still have power. (It seems like the DEA suspects some licensed operators of selling cannabis oil from Mexico. Which is confusing as that would be against CA law as well.)

In an inevitable conclusion, the Drug Enforcement Administration (“DEA”) and Department of Justice (“DOJ”) won their federal court case against the California Bureau of Cannabis Control (“BCC”) pursuant to which the BCC must now comply with a recent DEA subpoena regarding alleged criminal activity by certain state-licensed distributors hailing out of (what’s probably) San Diego (based on the court filings). Namely, it sounds like certain Southern California licensed distributors are (allegedly) moving cannabis oil out of Mexico into California.


This summer, the DOJ and the DEA sued the BCC because the BCC refused to comply with a DEA subpoena about the alleged extracurricular drug trafficking above. The DOJ’s July 20th court petition filing states that the DEA and the DOJ are seeking specific information from the BCC about six “entities” (which really means three corporations and each corporation’s “presumed owner”) that hold BCC licenses where the feds are conducting a criminal investigation (for violations of the Controlled Substances Act (“CSA”)). The BCC has refused to provide that information to the DEA

Amazing that less than 10% of 55+ guys and less than 4% of such women use the weed in all it myriad forms. They make it sound a bit frightening to use as an elder. Personally I'm 72 and a serious daily user. Its not one of my problems! Au contraire.

Maybe worth mentioning: people 55+ are at a ‘delicate stage of life, trying to keep it all together as they zero in on retirement. The legal status of cannabis almost certainly makes some people unwilling to admit even anonymously that they use it, for fear of judgmental repercussions that could be found out & end their careers at their most productive/rewarding stage...even in legal states.

The number of judgmental assholes hasn’t dwindled over the years; it may even have increased.
