I've been in contact with Vivant about this very same question, and the firmware updates will be downloaded on your computer hooked up to the USB on the device. I also asked about that silly 1 minute timer and it's basically in place for safety/liability reasons. +1 for a 5 minute session timer!

I had a very slight smell that went away after the first use. IMO a lot of the smells in new devices come from the foam packaging that they're shipped in.
