    This is exactly how I feel about it. I would be far more upset that I lost $20-100 dollars of oil than I would ever be about not having the side switch. I would have almost certainly put it in my pocket without remembering to turn off both switches as well, as would many others I am sure.

    Read the words, it says nothing about switch. It says safety lock, which you are getting. Everything else is exactly what is being included. The switch wasn't safe, so it wouldn't fit with the picture of what you paid for.

    I have no information about this specific case, but my experience with batteries in general is that they may have some charge or even be close to full. It is always good advice to make sure they are fully charged the first time before you start discharging though.
