Meeting with attorney was today.
Not good.
He has no information for us, because the indictment is sealed.
Patty and I are both being charged individually.
I am not sure why, since it was all me using and working with vapes and meds, but that is the fact.
Now I fear we have a new problem.
The attorney has informed us that he can not represent both of us in this.
He has a list of attorneys he works with, but this new development is frightening.
He said we can get a public attorney, and there would be a chance that it is a Defender that would cooperate and work with him.
The chances of it being a non cooperative attorney is greater, however, and so we must make decisions.
He knows of a young attorney that he trusts to stay on "the same page" and work together...
and the young attorney he explains will help at a better rate than most attorneys.
The Indictment hearing is the day after tomorrow.
Thursday.

We are both nervous and scared, due to all of the secrecy and the unknown.
We are still standing strong and calm, as best we can.

Show up and hold your head up high, you did nothing wrong. I'm sorry that you didn't get better news. I was hoping that it would blow over. I know nothing about the law so I hope you find out on Thursday what the part that's sealed is all about. It doesn't seem fair that you wouldn't be notified of all the info.

Vito and Patty. Keep on loving on each other.:love: I can asssume that you trust your initial counsel as he is stil in confidence. I know the cost can be great for independant representation. But I think if it were me and my wife, I would trust him and have the young advocate proceed. All my dealings with the (juvinile) judicial system I had a pubic offender. While some excel I know, I was given the reminents of what ever the lowest common denominator was. Two heads working is always a better bet I think. Even when you have to pay for both. Get us a estimated $ for his fees my friend. Between great representation a little help from your FC friends family and the good one above. We will push you both through the finish line.

What is going in in AZ that this kind of thing can happen?! Positive vibes to the both of you. You don't deserve any of this. It's a travesty. Stay strong, brother. Hopefully some light will start shining at the end of the tunnel.

Indictment Hearing was yesterday.
They held the arraignment.
We are placed under arrest.
The judge individually read us each our rights, and entered a plea of not Guilty.
The charges are:
Possession of Marijuana
and
Possession of Marijuana Paraphernalia.
Next will be a case management hearing.
A Case Management Hearing is a hearing—a pretrial hearing that is set after an arraignment. Now, the purpose of the Case Management Hearing is two things. The Judge wants to know, at a Case Management Hearing if there’s any problems with discovery. The Judge will also want to know if there’s any plea offer that has been made in the case. Most cases—most criminal cases do get resolved with plea offers. So, the Judge wants to know if one has been made.
Patty and I will meet with both of our attorneys at same time .. all 4 of us to talk before the Case Management Hearing.
Love still prevails here.

The Attorney that we will be trying to retain for Patty is the young one we spoke of.
We spoke a couple of times, and he is quoting a fair enough figure.
We meet with him on Tuesday, to actually "retain" him.

I told Patty that we ARE in the light, and that we will be fine.
And folks.... we are in the light.

I am extremely saddened by this news, and infuriated that the authorities can get away with doing this to you. I just don't understand how the world can be so cruel to such good people. I'm keeping you both in my thoughts. Stay strong, and hopefully things will take a turn for the better soon.

Best of luck. Those charges sound inflated, and if it's less than 2 pounds it goes right back to possession as I understand it. Don't let their fear game get to you. Glad to hear you both have legal representation on this. Keep us informed.

That would probably throw a dismissal, plea bargain, or diversion out the window IMO. @Vitolo mentioned how he was advised against this. I like the idea, but let's not make anything worse than needed until asked for help. His lawyers will know best. For now I'm just praying for a safe, quick resolution.

Sadly, I also believe that cases like this aren't unique. Really someone should change the state laws-- 2.5 ounce limit for medical patients is way too low. The media can only do so much.

No.
It means the threat looms worse than ever, and I am advised more strongly than before to stay out of media, and to stay to myself until the case has been over and resolved 100% (this includes any probationary period also).
He said when papers are signed and done.....
and whatever sanction (if any@!) placed against us has been fulfilled, and non- existant... we can reveal our ordeal.
His prediction is that any media nudging is "poking the bear" and we would worsen our situation without doubt, and in an irreversible manner.

This is shocking news! How they can do this to peoples lives and feel justified I don't know. I wish you two all the best in these dark times! What about setting up a pay pal account so people can chip in for the legal fees, even if it is a few dollars here and there this should be a fight we are all in!

As for the social media/media talk, good advice from your legal team. Not much you can do while they are playing their games.

Edit to add, I do not know what legal jurisdiction he is in and if I did I'd have no idea what the law may be:/ given donated items were initially ceased and an item is just a thing with monetary value, unless there were specifically ceased as parra I'd tread on the side of caution.

Neither of our consciences could handle anyone helping to the detriment of their own families needs or their own well being.
