On most police cars it's printed "to serve and protect". They need to be reminded of that.
To serve and protect everybody not who they choose. You are presumed innocent, supposably.

High Schools in the U.S should be requiring students to take classes reminding them of their constitutional rights. That's like a life skill in this day and age with folks getting their civil rights trampled on.

Thanks for sharing those photo's and of course your story. Women like yourself are the new face of the Cannabis movement. We need "soccer mom's" like yourself to help legitimize the image of the Cannabis industry. It's great to see some more Women finally getting involved!

Also, I am truly sorry for your entire ordeal and please don't take this the wrong way, but I am much more grateful for what you did and went through. So, thank you for standing up for what you believe is right and sharing your story with us. Don't think that this was all for nothing, it's just another step in making meaningful progress. :clap:

You (and all my new friends and supporters here) really made my night, @aesthyrian. I woke up depressed today as I thought of all the lawyers fees, the lost product (omg there was great stuff in there; the police don't know what they're tossing - unless they ARE using it!! haha), possibly jeopardizing the fine business contacts I made, and just the feeling that I was alone in this.
But I'm not alone. In reality, I'm not alone. You're right; I need to fight this fight just as I am. I need to keep up the dialogue and show people that ordinary citizens like me, moms, workers, teachers, middle of the road whoever, use and are proud of it! The more humanly diverse the face, the better.
I'm GLAD to be able to use my experience to help others. I won't stop in this and will utilize all of my creative powers to add one more dimension to the fight for justice.

In Nebraska:

Possession of 1 oz.- 1 lb. is a misdemeanor punishable by a maximum sentence of 3 months imprisonment and a maximum fine of $500. (http://norml.org/laws/item/nebraska-penalties-2)

My suggestion: your case probably depends on the way the police obtained evidence and trying to throw that out. Don't provide the authorities with another way to corroborate their evidence by posting details here.

Thanks Gunky. My lawyer will review the police report and the video and advise. The police already have all their evidence (my business cards and plan). But it's after the fact. The case will rest on what they knew or suspected at the time.

It's strange. Most of my life I've been a nervous type, often stressing over some imagined fear. Lately, and especially since this happened, I've begun to feel very very calm. Since the incident I have not vaped or smoked. I gave away what little herb I had left and haven't thought about trying to find more. It's just regular days of the usual ups and downs. Yet inside I feel like this smooth polished hard stone. A stone without being stoned, so to speak. I thought over the worst case scenario in regard to my plight. I could get a felony on my record. I could go to jail for three months. Wow. Sucks. Jail would be bad, not so much because of being in jail itself (I'm sure it wouldn't be pleasant but other people, many notable, have had to endure it - and why should I be treated specially?) but because I'd be away from my kids and I might lose my job. The felony would be really daunting. I couldn't vote. I'd have trouble finding another job, getting certain kinds of credit, moving overseas.
So why then do I feel so calm? When I search inside of myself for the answer all I keep coming up with is this: that I am right. I'm a hard polished stone of rightness. The cops with their dogs and their cuffs couldn't unnerve me. Once I knew what was happening, the crazy foolishness of it all, I immediately stopped being scared or stressed. In my mind I knew all the commotion had nothing at all to do with me. They played their game, they played it out. I am human and I am subject to being hurt, to being insulted, to being imprisoned even. I can't always avoid the ugly realities that are sometimes thrown at me. But everything has an end. The cops get bored and drive away. Terms, even awful ones, have limits. So what remains when all else has been burned off? Just the pure purpose. It's not any special bravery on my part. It's just that... I know I'm doing what's right, what's good. I believe that all people deserve being treated with dignity, I believe that everyone has a right to pursue happiness. I believe that marijuana should be legalized. As they removed our cuffs I looked each one of the cops in the eye and told it to their faces: "Fight to legalize it!"
This is my voice and I have to keep it even if it means that I experience personal trial. Because not to have it, not to use it, is I think the far worse imprisonment.

Your situation is so sad, that they'd waste resources on busting you for 3 oz of medicine.

So, boycotting Nebraska--how else can one go--Wy, SoDak, MN. WY: less than 3 oz is misdemeanor but 3+ oz is felony and potential 5 years and $10,000 fine. SoDak: 2 oz - 1/2 lb = felony 1 year, $4000. MN: 42 gm - 10 kg felony 5years, $5000. WI- 1st offense any amount misdemeanor 6 mo, $1000.
A different detour thru Kansas : any amount, first offense, misd- 1 year. Missouri: felony. Iowa: any amount first offense , misd, 6 months, $1000.
One needs to travel like Frogger

My meds are running low so was thinking of CO but this scares me.

Samantabha, I admire your idealism and share your outrage about the fundamental unfairness of what has happened to you and many others. Nevertheless I hope you will be realistic and recognize that the police and judicial system are quite unmoved by impassioned speeches and activist appeals to reform the system. They are busy grinding the machine they have. They are not making judgements about the fairness of the current cannabis legal setup or even to a great extent suspect police methodologies. They are not interested in reform, they are engaged in prosecuting an individual. Don't go getting a martyr complex because it won't help. This thing is very big and old and creaky and about to fall apart. Don't be the last victim in a war that is about to end.

Hey - I have an update for you: as I was going to work tonight I drove past this ENORMOUS billboard. It said "Ask why patients in Wisconsin can't have access to medical marijuana". There were two large marijuana leaves and the names of two representatives up for re-election in November. I can tell you that I have NEVER seen anything advertised like this before in Wisconsin. Never. We do have NORML (I will be formally joining soon and plan to start a chapter in my small town) but it's exceedingly rare to get really big public coverage of this issue. The billboard, like I said, is huge. And it's right on the major highway (94) connecting Milwaukee to Madison. Here's another song...."The times they are a chaaannging.."
I think that maybe the reason why I was busted - and why just about everybody now traveling Hwy 80 through Nebraska with out of state plates is being stopped and searched is precisely BECAUSE times are changing so fast. Like Gunky says, the old creaky thing is about to fall apart. Sometimes the enormity of such an event calls out the worst backlashes. Like the rise of feminism stirring vicious misogyny in those males who feel threatened by the change.

That is phenomenal news about the billboard! Gives me a warm fuzzy feeling deep inside that we are banding together for the benefit of the terminally ill, the recreational users, the coniseurs, and for future generations of MJ users to live their lives however the fuck they want! Oh wait.. that warm fuzzy feeling was a nice fat hit from the vape.. but regardless, ONWARD AND UPWARD!

Times are a changing but in some parts of the U.S is seems to be at a snail 's pace. Some of the ridiculous laws in the Republican dominated legislative and senate states. When searching online the laws are literally "all over the road" sorta speak. One state it's a misdemeanor and another state it's 5 years in prison, it's insane. So 1 mile down the road the laws can be that extreme.

I noticed that! And while some places have leaped ahead, others have taken some backward steps. It seems that we are in a state of confusion in this country.

Well we are all engaged in a bit of civil disobedience every time we plant a seed or crank up the vape. It's important to pick our battles, not just throw ourselves on the gears to be ground up.

The issue isn't whether she broke the possession law, it's whether the search and seizure was legal. Actually, it's pretty clear that it wasn't, so the real issue is whether the court chooses to ignore the Constitution. I'm sure her lawyer's advice will supersede yours, by the way. ;)

I got searched cuz it smelled like bud. But I had a trapped skunk on my roof, which the officer was aware of. That was ruled as legal. I learned the hard way that government works together, as long as they both win. Especially in small towns.

Edit-it's almost funny to me now, but still sucked!
