So apparently the police biology specialist thinks ABV is Tabacco and hash

Hey Guys,
Some of you may know me, I've been absent from here for almost a year, I'm 11 month sober going strong,
As some know I was arrested for Importing Cannabis to my country from Canada as I was ordering by mail.

Anyway long story short, you can have 15g for personal use...

I had 31g Cannabis and... 50g "Hash"

I did have lots of ABV stored for ... cooking... but I found out that the gifted biologists think its actually a bland of Tobacco and Hash!!!

This is just amazing...how can I fight this non sense???

geesh~ that sux man, are you in the US?

I guess you could try to fight it, I am no lawyer, unless they smoked it themselves it is likely in an evidence room somewhere. Your lawyer might be able to order some lab tests on the material. Is that possible?

I'm in Israel mate.

I think its possible to do more lab tests...it was tested in a lab... I guess they did find traces of THC but Tobacco and Hash? gimme a break

Have you stated to them that it's marijuana that's already been vaporized? They most likely have no idea what ABV is and were grasping at straws to come up with the tobacco and hash.

Pretty sad they couldn't figure it out though.

I would have thought, that with Israel being one of the leaders in MJ research, that it would not be such a big deal.

I just got back from Israel and decided against bringing anything in, too much heightened security these days wrecked my nerves.

they just need a demonstration of converting herb to ABV.

That's a good point, however I'm not sure how this could happen in court or so...but I told my lawyer to loop up in google for "ABV weed" and "duff weed" - we'll see what he can gather from that

Looking from another angle, you've been lucky, chances are if they knew the "tobacco" was cannabis plant matter then it would be added to the weight of cured herb found, iow AVB treated exactly like unused herb.

The forensic test for species identification is probably more complicated/expensive than drug identification & the oil residues from the avb probably have a similar signature to hash when tested, hence the it must be hash mixed with tabac assumption, iow they didn't test the plant matter just swabbed the avb with something similar to a pregnancy kit and bingo....hash was detected.

Might be best to keep quiet about AVB, instead request to know the weight of the "hash", &( depending on the rules of your legal system ) pay for an independent lab to separate & weigh the "hash", your lawyer should be able to arrange this( if allowed )....the weight will be a tiny fraction compared to total weight of AVB, also consider a thc % test to show the "hash" is very weak compared to normal hash....just make sure the right tests are requested to avoid a species id taking place on the "tobacco".

Lucky? I don't see that aspect. Hash laws can be/are ridiculous, plus the way the laws are worded is another doubled edged sword to battle. IMHO, I believe the quicker that it is pronounced slightly used cannabis with low THC % the better.

Depends on the country, hash is treated exactly the same as plant matter here, 1-100% thc, any form, the law doesn't discriminate, they just weigh it & call it cannabis.

He will need to consider hash weight against AVB/plant weight....& how local laws see these things, before deciding how to play this.

I doubt very much the court will recognise the concept.

It depends on what state you're in, remember this happened in texas just recently:

Texas 19-year-old facing life in prison for hash-infused brownies
"Cops in Round Rock, Texas have used a legal loophole to charge Jacob Lavoro, 19, with possession and distribution of 660 grams of hash over a tin of pot brownies. The felony charges carry a penalty of five years to life in prison - and all because Lavoro used hash oil instead of raw cannabis in his recipe."

The quick take is they were somehow able to charge him with the entire weight of the brownies as hash.

Right now where i live 20 grams and under of flower is a misdemeanor. 3 grams or over of hashish is a 3rd degree felony.

BUT If caught within 1000 ft of a school(pre-school to post grad), child care, Park or community center, ANY Convenience Business, Public housing , assisted living facilities, nursing homes , Hospitals and any Church or place of worship or just anywhere people conduct Religious activities. No matter if you have a gram of herb or 60 grams of hash it's(or at least you can be charged with) a Second degree Felony, Much worse.

Seems like they pretty much covered it all. So if you ain't totally in the middle of nowhere it's a felony.
I do know Prosecutor's Do love to be able to stack charges and much of Florida law is written to give them that ability when wanted.

"Convenience business". WTF ? as a legal term seems kinda undefined as far as i can tell, in some counties i read it's only small stores and gas stations from 1 am - 5 am. In others it's any place where trade of goods or services for money may happen, any time of day.

The medical use of marijuana and hashish is not punishable under Israeli law if the same is approved by a person or body appointed by the Ministry of Health.

The punishment for using cannabis is not severe for “personal use” and the amount defined for personal use is 15 grams of marijuana and hashish. Patients suffering from nausea induced by chemotherapy or those in the later stages of HIV are allowed to enter a medical marijuana program.

I would be pressing for the "hash" to be separated from the "tobacco" and weighed.

If the cops realise the "hash" mixed with "tobacco" is actually AVB ....then total weight of AVB might be treated like fresh herb....which is bad.

I think its already separated because I have like 80g of ABV ... but we know that more than 15g is a problem...but only 31g is no biggie...the big issue is that I imported ... which is absurd that if I went to a drug dealer in Israel it would have been better...

Anyway, I'm not sure what is the correct thing to do, deny because its not hash? prove that there's no tobacco ? I'm guessing its easy to prove so...maybe it will help my medical argument...

Anyway, lawyer is in USA for 2 more weeks...

So...they found 80g of cannabis which they have logged as 31g of cannabis, sounds good to me.

Did they intercept the parcel on route?
Was the parcel delivered to your home...then they busted your home?
Have you admitted arranging the parcel?
What evidence do they have you imported cannabis?

What is the advantage to you for the prosecution to know the tobacco is actually cannabis?
You would rather they charged you with 80g not 31g?
For a medical argument to fly they will probably be more interested in medical/hospital records than a cannabis delivery system, meaning I don't think it matters if you vape or smoke, those things don't prove you're ill.
