Anyone with canadian law experieince? I got busted and im scared!

I didn't recommend that he defend himself. My recommendation was:

If you can't afford a lawyer then ask for legal aid.

Sorry if that was unclear. What I was also saying was that if he took the risk, chances are reasonable that the outcome would be the same as they would be if he had a lawyer.

Also, I can see that you are not at all familiar with the situation concerning marijuana here. It is extremely unusual for charges to be laid here under the circumstances weedemon described. It is even rarer for the Crown to proceed to Court because it's considered a waste of the Court's time. I just checked with a cop I know and that's what he told me. (He also said that cop must have been a real dickhead.) As I said, it isn't possible to be 100% sure of what will happen, but if anything but an absolute discharge was given I'd be surprised.

There are other GTA residents here. If any of them is aware of a case in recent years in which it wasn't resolved as I described, I'd like to hear the story. I'm not saying it never happens, but I am saying it would be quite rare.

I feel the cop was being a dick, he was very alpha male and dominant. but that said I also see his point of view. he asked me what this was and i told him something that he though was a lie.

If i learned anything it's don't try to be smart like that, you will get f'd.

I have contacted a lawyer and have laid out my story to them.

in the mean time while i wait for a reply, someone else was kind enough to help me out with the following advice.

DONT WASTE MONEY ON A LAWYER yet. Go to your first court appearance where you will talk to Duty Council. They will most likely offer you the Alternative Measures Program or aka the Diversion Program, which involves either some community hours and/or making a charitable contribution of around 200.00. If you accept the program, all charges are dropped and your record stays clean (double check that with them though).

What do you guys think of this advice? (To the person who gave me this advice. Please take no offence, I just wanted to be sure!) Imagine if I showed up, and this was not accurate, and then i had to defend myself! :uhoh: I'm not saying I doubt your advice at all, I just want to double check! :peace:

For such a small amount i'd personally do exactly this, if you had been busted with a pound or 2 i'd say go get a lawer but for such a small amount you likely don't have much to worry about

....add me to the list of folks who think you will be fine.....however, it is ALWAYS prudent to talk to an attny...try to learn from this experience...unless you're good at it, lying to the cops over "small shit" only pisses them off....you need a portable vape...

You can ask the lawyer I referred you to. My guess is that she will tell you that this will probably work.

Basically, this charge is a huge waste of time for the Crown. If you entered a not guilty plea, the cost in time and money would be huge. They have to get the weed tested, for example. Lots of time and money wasted there. The cop has to show up and prove that you were the one holding it, not someone else, etc etc. This is why I have been saying a lawyer (whether legal aid or hired) will simply get you a plea bargain for an absolute discharge.

If it doesn't happen as described, then you will not have to defend yourself. You can simply ask for a remand (which they will grant) because you haven't gotten a lawyer yet. Then you can go get a lawyer. I think that advice is sound, however, and it will go down as described. If the charges are dropped completely, this is even better than a discharge.

Up until I came to this site, I always thought the illegality was part of the game. Dont do the crime, if you cant do the time, I thought.

MJ is the tree of life, and has personally given me so much, as has many of you who have testified how Mj has/is helping people in their everyday struggles.
I am a reluctant warrior in this war on drugs, conscripted by circumstance, labelled a criminal by my government & vigorously hunted by those who have sworn to protect me & my community.

(Although, in my community you dont go out at night cuz its not safe for anyone but the violent yahoos who roam the streets without fear or punishment)

Yet we are the criminals, the passive stoners, the sick, as well as those who refuse big pharma & their addictive, destructive opiates.
I never wanted to be an activist, but this war is unjust.
I am not a criminal, & I refuse to act like one.

Because My job that I got is only part time (the best I could find), I was living at home. This allowed me to pay down my student debt a bit, but it is slow going. Now, because I told them the truth, about me getting caught for possession, they have decided the best way to help me is to tell me I am on my own and have to GTFO. (But they are there for me emotionally...) LMAO, wtf.

Well, I'm lucky I have good friends. My best friend happens to have a spare room for at least 3 months. After that I need to figure out something more permanent. Hopefully I will have a better job lined, up and I will be able to afford to move out before my 3 months even. Atm, I don't even have a normal first and last months rent, but because of the rate he is giving me, I can afford it :) but otherwise I would just be screwed. (He's only charging me first anyways)

My job pays between 600-900 bucks a month. I have car insurance, rent, food, cellphone bill, gas. And then let's not forget my student debt!!! holy shit. It feels like I'm stuck in a tar pit and I will never get out.

but seriously, thank goodness for friends. And new job prospects on the horizon!

I had 2 fucking fantastic years prior, I was in love, I was going to school and had big hopes and dreams of what my future held for me. I was so happy and excited looking forward to the future. 2 wonderful fantastic years, the happiest I have ever been in my entire life. Now it seems I get to have 1 and now going on 2 crappy years. But hey, maybe it`s just a lil left over karma from 2011. Things have to look up right? I honestly can`t see things getting that much worse! haha

Wow dude, you have had a rough ride from life lately! I'm sending good thoughts your way.

Some random thoughts:
Be polite, respectful and well-dressed/groomed for your chat with "the law". Try to come across as a good kid that merely had a "youthful indiscretion" and you'll have nothing to worry about. Be serious and make it clear that you have learned a valuable lesson from this and won't repeat it.

Anyway. Keep your chin up. Your attitude reveals a strong character, so don't be afraid. You'll be fine.

I am sorry to hear of your bad situation :(

I know this may be a drop in the bucket, but if you are not earning enough money to pay off your student loans, you should speak to your lender about getting a forbearance. I'm not sure how it works in Canadia, but I can't imagine it is that different from down here in the states. The lender would probably much rather let you get a break through official means rather than take the risk that you will simply default one day

im back. :)
yep it was a good day at court I got the diversion program like it was said on here.
I got 35h community service, and that was it. I have 8 weeks to complete it. all that for such an awesome turn out.

Now if i had only not told my family about it. haha

my lesson from all this surprisingly was that even though I thought my family would always have my back no matter what. they decided to draw a line in the sand on this issue and the result was me getting cut off, and kicked out. Amazing, but true. if only i had never told them...
